Liability Waiver
Please read carefully. This is a release and waiver of important legal rights.
The individual named below (referred to as "I" or "me") desires to participate in Masters of the Dungeon Verse’s Special Program (whether singular or plural, hereinafter referred to as the "Activities") provided by Masters of the Dungeon Verse, a subsidiary of NuMinds Enrichment LLC, a Texas limited liability company (the "Company"). As lawful consideration for being permitted by the Company to participate in the Activities, I agree to all the terms and conditions set forth in this release (this "Release").
Although reasonable precautions are taken to provide proper organization, instruction, and equipment for my participation at Masters of the Dungeon Verse’s Special Program, there can be no guarantee of absolute safety against injury and accident. There are elements of risk in any program (individually, an “Activity” and collectively, the “Activities”) and the use of any equipment in connection with the Activities. I understand that I may be involved in Activities, including but not limited to, arts and crafts, cooking, eating food provided by us, science, team-building initiatives, games, archery, axe throwing, carpentry, controlled fire use, martial arts and self-defense training, and/or other physical undertakings. I am aware and understand that some activities can be dangerous activities and involve the risk of serious injury and/or death and/or property damage. I acknowledge that any injuries that I sustain may be compounded by negligent emergency response or rescue operations of the company. I acknowledge that participation by me or my Child in any Activities is voluntary and that I may decline to participate in any Activities.
ACKNOWLEDGMENT OF RISKS: I recognize that there is inherent danger in any Activities that involve physical exertion or risk taking; that although the program may not be strenuous, injuries or medical complications may occur; that certain foreseeable and unforeseeable events unique to each Activity can contribute to the unpredictability of the Activity; and that balance, physical coordination, and conditioning may affect the occurrence of accidents, falls, and injuries.
I understand that while the company has implemented measures to reduce the risk of injury from the activities, the company cannot guarantee that I will not be injured due to my participation in the activities. I acknowledge that I am knowingly and voluntarily participating in the activities with an express understanding of the danger involved and hereby agree to accept and assume any and all risks of injury, disability, death, or property damage, whether caused by the ordinary negligence of the company or otherwise. Further, if I am entering into this release as a guardian of a minor, I have explained the above risks to such minor.
EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY: In recognition of the inherent risks of the Activities in which I will be engaged, both seen and unforeseen, I confirm that I am capable of participating in the Activities and/or using equipment in connection therewith. I assume full responsibility for personal injury, accidents or illnesses, including death, except to the extent caused by the negligence of Masters of the Dungeon Verse, or anyone for whom is legally responsible. I also assume responsibility for loss of or damage to my personal property. I assume the risk(s) of personal injury, accidents, and/or illnesses of all kinds and nature, including, but not limited to, cuts, wounds, scrapes, abrasions, and/or contusions, sprains, and/or death.
I confirm that I am: (a) in good health, in proper physical condition, and do not have any medical or other conditions that would impair my ability to participate in the Activities. I will comply with all federal, state, and local laws, orders, directives, and guidelines related to the Activities, including, but not limited to, laws regarding alcohol and drugs while participating in the Activities. I understand that my participation in Activities while intoxicated is strictly prohibited. I will also follow all instructions, recommendations, and cautions of the Company at all times during the Activities. If at any time I believe conditions to be unsafe, that I am no longer in proper physical condition to participate in the Activities, I will immediately discontinue further participation in the Activities.
AUTHORIZATION: I hereby authorize any medical treatment deemed necessary in the event of any injury to myself while participating in the Activities. I have appropriate insurance or, in its absence, I agree to pay all costs of medical services and medical transport as may be incurred on my behalf.
RELEASE, HOLD HARMLESS AND COVENANT NOT TO SUE: In consideration of my participation in the Activities, I do hereby for myself, my Child and our respective administrators, executors, heirs, spouse, dependents, successors, and responsible parties knowingly and intentionally release, forever discharge and covenant not to sue Masters of the Dungeon Verse or our venue partners and its employees and volunteers (collectively, “MDV Special Program”) from and against any claims, demands, expenses, actions and causes of action of every name, type, and nature I or we now have or may ever have arising out of my participation in the Activities and on any subsequent dates during which I participate in the Activities. This waiver and release does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that Texas law does not permit to be released by agreement.
USE OF PICTURES: By agreeing to the Release of Liability Form, you hereby authorize and give Masters of the Dungeon Verse permission to take, use, publish, and reproduce photographs, videos, and other images of your child for Masters of the Dungeon Verse or our venue partner’s website, brochures, group photos, or other media.
ACKNOWLEDGMENT: By typing my name, choosing agree, completing registration and/or dating this agreement, I acknowledge and represent that I have fully reviewed it and understand what it means, and that I agree to this document as my free act and deed. No oral representations, statements, or inducements, apart from the foregoing written statement, have been made. I further agree that this Agreement shall be construed in accordance with the laws of the Commonwealth of Texas. If any of its terms or provisions shall be held illegal, unenforceable, or in conflict with any law, the validity of the remaining portions shall not be affected thereby to the fullest extent permitted by law. I further state that I agree that I, my child and our respective estates, heirs, administrators, personal representatives, and assignees shall be bound by the same.
Virtual Programs
Acceptable Use Policy
While engaging with Masters of the Dungeon Verse Online, student participants will abide by the following guidelines:
General Internet Access and Usage:
Students will not intentionally visit Internet sites that contain obscene, illegal, hateful or otherwise objectionable materials.
Students will report accidental accessing of inappropriate materials in accordance with program procedures.
Students will use the Internet for educational purposes only.
Students will not copy information into assignments and fail to acknowledge the source (plagiarism and copyright infringement).
Students will never disclose or publicize personal information.
Downloading by students of materials or images not relevant to their studies is in direct breach of the program’s acceptable use policy.
Students will be aware that any usage, including distributing or receiving information, school-related or personal, may be monitored for unusual activity, security and/or network management reasons.
Chat and Messaging:
Students will only have access to chat platforms, discussion forums, messaging or other electronic communication forms that have been approved by Masters of the Dungeon Verse (this includes those within the Google Classroom platform, Roll20.net, and Discord).
Chat rooms, discussion forums and other electronic communication forums will only be used for educational purposes and will always be supervised.
Face-to-face meetings with someone organized via Internet chat will be forbidden.
Sharing and Publication of Student Work and Projects:
Students will be given the opportunity to publish projects, artwork or coursework onto the closed (not open to the public) digital learning platform provided by Masters of the Dungeon Verse.
The platform will be regularly checked to ensure that there is no content that compromises the safety of students or staff.
The platform will be checked frequently to ensure that it does not contain personal details.
Personal student information including home address and contact details will be omitted from all information posted on the online learning platform.
The online learning platform will avoid publishing the first name and last name of individuals in a photograph.
Masters of the Dungeon Verse reserves the right to share images of student work published onto the learning platform on our social media, website, and general marketing materials, with NO personal identification information included.
The information regarding photography and video usage from the general waiver applies to student work posted on the Masters of the Dungeon Verse online platform.
Sanctions and Consequences:
Misuse of the Internet and/or digital platforms related to Masters of the Dungeon Verse may result in disciplinary action, including written warnings, withdrawal of access privileges and, in extreme cases, suspension or expulsion from the program. Masters of the Dungeon Verse also reserves the right to report any illegal activities to the appropriate authorities.
Note to Parents/Guardians:
As part of Masters of the Dungeon Verse’s online experience we offer students supervised access to online learning and communication platforms, such as Google Classroom, Roll20.net, and Discord. This allows students access to a large array of online educational resources that we believe can greatly enhance students’ learning experience. However, access to and use of the Internet requires responsibility on the part of the user and the educational organization. These responsibilities are outlined in the following Acceptable Use Policy and violation of said policies may result in a removal from the program without a refund. It is important that this enclosed policy is read carefully, signed (or digital use of initials or selecting “agree”) by a parent or guardian. Although Masters of the Dungeon Verse takes active steps to promote safe use of the Internet, it recognizes the possibility that students may accidentally or deliberately access inappropriate or objectionable material. Masters of the Dungeon Verse respects each family’s right to decide whether or not to allow their children access to the Internet as defined by Masters of the Dungeon Verse’s Acceptable Use Policy.
All new players and their parents (who have not been personally referred) will need to schedule a virtual orientation video meeting with a host from Masters of the Dungeon Verse before they attend their first session. This meeting is to give you a chance to learn more about the program and for us to learn about you and your experience with role play. This allows us to create a more customized experience and add a layer of security through identity verification. Keeping a safe space to learn and grow is at the top of our checklist.
